Why do I need an ID check to buy or sell a property?

IF you’re buying or selling property, you may be surprised when your conveyancer asks you to complete an identity check — especially if you’ve known each other for years.
According to Anna Przibilla, conveyancing manager and registered conveyancer at Kadina-based law firm Mildwaters Byrth, it’s one of the biggest changes affecting property transactions this year.
“From July 1, 2026, new federal anti-money laundering laws require every conveyancer and lawyer in Australia to formally verify a client’s identity before we can act on a property sale or purchase,” Ms Przibilla said.
“It doesn’t matter whether we’ve known you for decades or have helped your family with property matters before.
“The law applies equally to every client.”
While the new requirement may feel unusual in closeknit communities, Ms Przibilla said it isn’t about trust.
“We’re not questioning who you are.
“These checks are now a legal requirement because real estate has been used for money laundering across Australia.
“Every firm must complete them, whether they’re in a capital city or a regional town.”
The good news is the process is straightforward.
Most clients receive a secure link by SMS or email and can complete the verification in just a few minutes using their smartphone.
The process includes photographing identification documents, taking a quick selfie and securely submitting the information.
For those who would rather complete the process in person, local support is available.
“One of the advantages of working with a local conveyancing team is that we’re here to help,” Ms Przibilla said.
“If technology isn’t your thing, or your circumstances are a little different, you can come into our Kadina or Minlaton office and we’ll guide you through the process.”
Ms Przibilla recommends completing the identity check as early as possible to avoid any unnecessary delays later in the transaction.
