The change marks the formal inclusion of Joel Byrth as a director alongside firm founder Kylie Mildwaters, solidifying a partnership that has been years in the making. 

Mildwaters Lawyers has long been involved in pivotal moments facing farming families, and the rebranding will ensure the firm is poised to continue this work into the future, Mrs Mildwaters says.

With the average age of Australian farmers now around 63 and the average intended retirement age about 68, many more farmers than usual are expected to retire within the next five to six years.

This impending wave of retirements signals a critical juncture for Yorke Peninsula’s farming community, necessitating urgent discussions about farm succession planning.

“As farmers approach retirement, it’s crucial that decisions about farm succession are made as early as possible,” Mrs Mildwaters says.

“We need to ensure all family members understand and accommodate the complexities involved, such as balancing inheritance for on-farm and off-farm heirs.

Another issue of concern is the inadequacy of do-it-yourself will kits, Mr Byrth says.

“Many families believe they can save time and money with will kits, but these documents often lack completeness and clarity,” he says.

“This oversight can lead to significant additional costs and complications when it is time to administer the estate of the will maker.

“We are committed to educating the community about the importance of professionally prepared wills to ensure all legal issues are properly addressed.”

Mildwaters Byrth Lawyers & Conveyancers has also expanded its conveyancing services to meet growing demand, now employing two dedicated, registered conveyancers.
