CHALLENGED to imagine a world run by conveyancers, the Mildwaters Byrth Lawyers & Conveyancers team reckoned they’d like you to meet yours just after birth.
While you’re registering that birth certificate, they’d say, why not open a conveyancing file for your child’s future property needs?
Of course, this is wildly exaggerated, but registered conveyancer Anna Przibilla is making an important point about timing that could save you significant stress and money.
“In our imaginary conveyancer-ruled world, before attending a single open inspection, you’d consult with your conveyancer about areas you’re considering,” she said.
“You’d say ‘I’m thinking of looking at houses in Kadina this weekend’ and your conveyancer would say ‘Let me run a full title search on EVERY property in Kadina so you know exactly what you’re getting into before you even step foot in a home’.
“While running searches on every property would be excessive, this is where our fantasy starts overlapping with practical advice.”
Ms Przibilla says if you’ve narrowed down your search to a few properties, it not actually ridiculous to touch base with your conveyancer, who can check titles for easements or encumbrances that might affect your decision.
“If you drive around a new subdivision at Moonta or any new estate, you’ll notice none of them have front fences — that’s because they’re not allowed to have front fences,” she says.
“At the Dunes, you’ll notice they’ve all been designed with specific house styles because that’s what the encumbrance requires.”
Beyond the fantasy scenarios, the ideal time to contact your conveyancer is immediately after signing a contract to purchase.
However, there are situations where earlier contact makes perfect sense: when you’ve shortlisted properties (to get titles checked for potential issues), when you’re planning to bid at auction (to understand your obligations), before signing anything (to allay uncertainty about the contract or Form One), and when you decide to sell (to get advice on ATO clearance).
“Having an experienced local conveyancer by your side is the next best thing to conveyancers ruling the world,” Ms Przibilla says.
